1. Acceptance of Terms
By creating an account or using TradeMentory (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
These terms apply to all users of TradeMentory, including free and paid subscribers.
2. Description of Service
TradeMentory is an AI-powered trading journal and performance coaching platform. The Service allows users to:
- Import trade records from broker CSV exports
- Annotate trades with strategy, emotional state, and rule context
- Generate AI coaching reports that identify behavioral patterns and rule violations
- Access performance statistics and coaching insights
TradeMentory is a performance coaching tool. It does not provide financial advice, trading signals, investment recommendations, or any form of regulated financial service.
3. Account Registration
To use TradeMentory, you must:
- Provide a valid email address
- Create a secure password
- Be at least 18 years of age
You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access to your account at support@tradementory.com.
4. Subscription and Payments
Free Plan
A free tier is available with limited features as described on the pricing page. No payment is required.
Pro Plan
The Pro plan is available on a monthly subscription basis. Payment is processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.
Beta Pricing
Users who subscribe during the beta period at the advertised rate will retain that rate for as long as their subscription remains active and in good standing.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
Price Changes
We reserve the right to change pricing for new subscribers. Existing subscribers will be given 30 days' notice before any price change takes effect.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract source code from the application
- Upload malicious files or attempt to compromise the Service's security
- Share your account credentials with others
- Use the Service to store or transmit content that infringes third-party intellectual property rights
- Attempt to access other users' data
6. Your Data
You retain ownership of all trade data, annotations, and content you upload to TradeMentory. By using the Service, you grant us a limited licence to process your data for the purpose of providing coaching analysis and displaying it back to you.
We do not claim ownership of your trade data and will not use it for any purpose other than operating and improving the Service as described in our Privacy Policy.
7. AI Coaching — Important Disclaimer
TradeMentory's AI coaching reports are generated by analysing your trade data against documented strategy rules. These reports are for educational and performance improvement purposes only.
TradeMentory does not provide:
- Financial advice
- Investment recommendations
- Trading signals
- Any guarantee of trading profitability
Past performance data shown in coaching reports does not guarantee future results. Trading involves substantial risk of loss. You are solely responsible for your own trading decisions.
8. Intellectual Property
The TradeMentory application, including its design, code, branding, and strategy library content, is owned by TradeMentory and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without written permission.
9. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to perform maintenance, updates, or modifications at any time. We will not be liable for any downtime or service interruptions.
10. Limitation of Liability
To the maximum extent permitted by applicable law, TradeMentory shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of profits or trading losses
- Data loss resulting from technical failures
- Decisions made based on AI coaching output
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms of Service. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice in the application. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
